1. Agreement to Terms

3. Account Registration and Use

3.1 Account Creation

PiratSwap provides PC hardware upgrade services, including component installation, system optimization, and technical consulting. Our specific service offerings and prices are described on our Website and may be modified from time to time.

4.2 Product Availability

All Products are subject to availability. We reserve the right to discontinue any Product at any time. If a Product is unavailable after you place an Order, we will notify you and provide options for substitution or refund.

4.3 Product Descriptions

We strive to accurately describe all Products on our Website. However, we do not warrant that Product descriptions or other Content are accurate, complete, reliable, current, or error-free. If a Product is not as described, your sole remedy is to return it in unused condition.

4.4 Technical Requirements

Some Products may have specific technical requirements or compatibility limitations. It is your responsibility to ensure that the Products you order are compatible with your existing hardware. We are not responsible for compatibility issues if you provide incorrect information about your system specifications.

5. Orders and Payment

5.1 Placing Orders

By placing an Order, you offer to purchase the Products specified in your Order. We may accept or decline your Order at our discretion. An Order is not accepted until we confirm acceptance and provide an Order confirmation.

5.2 Pricing

All prices are listed in Euros and include applicable taxes unless otherwise stated. We reserve the right to change prices at any time without notice. The price charged for a Product will be the price in effect at the time the Order is placed.

5.3 Payment Methods

We accept various payment methods as indicated on our Website. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge your payment method for the total amount of your Order.

5.4 Invoicing

For business customers, we will issue invoices in accordance with applicable tax regulations. You agree to provide accurate billing information for invoice purposes.

5.5 Refunds and Cancellations

Orders may be canceled before shipment or service commencement. Once a service has begun or a product has been shipped, our Refund Policy applies. Please refer to our separate Refund Policy for details.

6. Delivery and Performance

6.1 Delivery Methods

We offer various delivery methods for Products and on-site or in-shop service options for PC upgrades. Available methods and associated costs will be displayed during the checkout process.

6.2 Delivery Timeframes

We aim to deliver Products and perform services within the timeframes indicated on our Website or in our communications with you. However, these timeframes are estimates and not guarantees. Delays may occur due to factors beyond our control.

6.3 Risk and Title

Risk of loss and damage to Products passes to you upon delivery. Title to Products passes to you when we receive full payment.

6.4 Inspection

You should inspect all Products upon delivery and report any damages or defects within 48 hours. For services, you should inspect the work performed and report any issues within 48 hours of service completion.

7. Warranties and Disclaimers

7.1 Product Warranties

All Products come with manufacturers' warranties. We do not offer additional warranties unless explicitly stated. Details of manufacturers' warranties are available upon request.

7.2 Service Warranty

We warrant that our services will be performed in a professional manner in accordance with industry standards. This warranty is valid for 30 days from the date of service completion. Your sole remedy for breach of this warranty is re-performance of the deficient services.

7.3 Disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PIRATSWAP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PIRATSWAP DURING THE 6-MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

8. User Content and Conduct

8.1 User Content

You retain ownership of any User Content you submit through the Services. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your User Content in connection with operating and promoting the Services.

8.2 Content Restrictions

You agree not to post User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Infringes any intellectual property or other right of any party
• Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
• Is false, misleading, or deceptive
• Promotes illegal activities or contains instructions for illegal activities

8.3 Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Attempt to gain unauthorized access to any part of the Services or to accounts, computer systems, or networks connected to the Services
• Use any robot, spider, scraper, or other automated means to access the Services
• Bypass or circumvent measures employed to prevent or limit access to the Services

9. Intellectual Property

9.1 Our Intellectual Property

The Services and all Content provided by PiratSwap, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the property of PiratSwap or its content suppliers and protected by international copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services and Content for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Services or Content unless expressly authorized by us.

9.3 Feedback

If you provide us with any feedback or suggestions regarding the Services, you hereby assign to us all rights in such feedback and agree that we shall have the right to use such feedback in any manner we deem appropriate without any obligation to you.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Latvia, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall first be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiation, either party may submit the dispute to the competent courts of Latvia.

10.3 Time Limitation

Any cause of action you may have with respect to these Terms or the Services must be commenced within one (1) year after the cause of action arises; otherwise, such cause of action is permanently barred.

11. General Provisions

11.1 Entire Agreement

These Terms, together with any other legal notices and agreements published by PiratSwap, constitute the entire agreement between you and PiratSwap concerning the Services.

11.2 Severability

If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of PiratSwap.

11.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, at our sole discretion, without restriction.

11.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government action, labor disputes, or Internet service disruptions.
